Terms of Service

These Terms of Service govern your access to and use of Pepcheck. Please read them carefully — they include important disclaimers, a limitation of liability, and a binding arbitration agreement.

1. Acceptance of terms

These Terms of Service (the “Terms”) are a binding agreement between you and Pepcheck (“Pepcheck,” “we,” “us,” or “our”). By accessing or using our website and services (together, the “Services”), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

Please read Section 13 (Limitation of liability) and Section 16 (Dispute resolution & arbitration) carefully. They limit our liability and require most disputes to be resolved by binding individual arbitration rather than in court.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements and that all information you provide is accurate.

3. Informational service only

Pepcheck is an independent information and comparison service. We aggregate and present publicly available information about pricing, medication concentrations, and provider availability for compounded GLP-1 medications. We are not a pharmacy, a telehealth provider, a prescriber, a medical practice, a manufacturer, or an insurer. We do not prescribe, sell, dispense, ship, or fulfill any medication, and we are not a party to any transaction between you and a third-party provider.

4. No medical advice

The content on the Services is provided for general informational and educational purposes only and is not medical advice, diagnosis, or treatment. It is not a substitute for professional medical advice. Always seek the advice of a licensed physician or other qualified health provider with any questions about a medical condition or medication. Never disregard professional medical advice or delay seeking it because of something you read on the Services. Decisions about medications, including compounded GLP-1 products, should be made only in consultation with a licensed healthcare professional. If you think you may have a medical emergency, call your doctor or 911 immediately.

5. No endorsement of providers

Listings, comparisons, and rankings on the Services do not constitute an endorsement, recommendation, or guarantee of any provider, product, or service. Rankings are generated using objective criteria such as verified all-in price and are not a judgment about the safety, quality, legality, or suitability of any provider or product for you. You are solely responsible for evaluating and selecting any provider, and for confirming that a provider and product are appropriate and lawful for your situation.

Compounded medications are not FDA-approved and are not reviewed by the FDA for safety, effectiveness, or quality before being marketed. You should discuss the risks and benefits with a licensed healthcare professional.

6. Pricing & availability accuracy

We work to keep pricing and availability information accurate and current, including by recording a “last verified” date where shown. However, prices, membership fees, dosages, product offerings, and provider availability change frequently and may vary by state, dose, and individual circumstances. We do not guarantee that any information on the Services is accurate, complete, current, or free of error. Always confirm the current price and terms directly with the provider before making any purchase. Any price you obtain from a provider, not the price shown on our Site, governs your transaction.

7. User-submitted content

The Services may let you submit reviews, ratings, or other content (“User Content”). You retain ownership of your User Content, but you grant Pepcheck a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, publish, and display your User Content in connection with operating and promoting the Services.

You represent and agree that your User Content:

  • is truthful and reflects a genuine, good-faith experience or opinion;
  • does not contain your or anyone else’s sensitive personal or health information;
  • does not infringe any third party’s rights or violate any law; and
  • is not unlawful, defamatory, harassing, deceptive, or spam.

We may, but are not obligated to, review, moderate, edit, or remove User Content at our discretion — including to prevent abuse or comply with law — without notice. We are not responsible for User Content, which reflects the views of the person who submitted it and not Pepcheck.

8. Acceptable use

You agree not to:

  • use the Services in any unlawful manner or for any unlawful purpose;
  • scrape, harvest, or use automated means to access the Services except as permitted by our published machine-readable files;
  • interfere with, disrupt, or attempt to gain unauthorized access to the Services, our systems, or other users’ accounts;
  • introduce malware or otherwise attempt to compromise the integrity or security of the Services;
  • submit false, misleading, or fraudulent reviews or other content; or
  • misrepresent your affiliation with any person or entity, or impersonate others.

9. Affiliate disclosure

Pepcheck may earn a commission when you click certain links to providers and sign up, at no additional cost to you. Where present, affiliate links are disclosed clearly. Affiliate relationships do not influence our rankings, which are ordered by objective criteria such as verified all-in price.

10. Third-party sites & providers

The Services link to and reference third-party websites, pharmacies, and telehealth providers that we do not own or control. We are not responsible for the products, services, pricing, content, privacy practices, or conduct of any third party. Any dealings you have with a third-party provider — including purchases, consultations, prescriptions, and fulfillment — are solely between you and that provider and are subject to that provider’s terms and policies.

11. Intellectual property

The Services, including their text, design, graphics, logos, compilations of data, and software, are owned by Pepcheck or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the Services without our prior written permission. All trademarks and brand names referenced on the Services are the property of their respective owners and are used for identification only.

12. Disclaimers of warranties

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, PEPCHECK DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION (INCLUDING PRICING AND AVAILABILITY) IS ACCURATE, COMPLETE, OR CURRENT.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PEPCHECK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, ANY THIRD-PARTY PROVIDER OR PRODUCT, OR ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON INFORMATION FROM THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify, defend, and hold harmless Pepcheckand its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, your violation of these Terms, or your violation of any law or third-party right.

15. Governing law

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.

16. Dispute resolution & arbitration

Please read this section carefully — it affects your legal rights. Except for disputes that qualify for small-claims court or claims to protect intellectual property, you and Pepcheck agree to resolve any dispute arising out of or relating to these Terms or the Services through binding individual arbitration, and not in court, before a single neutral arbitrator. Arbitration will take place in Delaware, United States (or remotely where available), and judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. You and Pepcheck agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@pepcheck.co with your name and a clear statement that you wish to opt out of arbitration. This section survives termination of these Terms. Nothing in this section prevents either party from seeking injunctive or other equitable relief for matters related to data security, intellectual property, or unauthorized access.

17. Changes to the Services or terms

We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

18. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, the provisions of these Terms that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will continue to apply.

19. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Pepcheck regarding the Services and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our consent; we may assign them freely. Section headings are for convenience only.
